While Beacon Hill Nannies, Inc. endeavors to use its best efforts to recruit and refer qualified applicants that the company believes will accommodate your requirements and particular needs, you understand that the company cannot warrant that the information provided to it by the applicants is true or accurate, or that your employee will perform her duties to your satisfaction or will otherwise be suitable for the specific needs of you and your family. By "submitting" this application and agreement you understand and agree to release and discharge us, and our officers, directors and agents, from any liabilities, losses, obligations or damages incurred by you as a result of our referral or your employment of any employee through Beacon Hill Nannies, Inc.
Beacon Hill Nannies, Inc. (BHN) invests significant time and expense recruiting, screening and training our high caliber, nanny/governesses. BHN’s superior level of service, our extensive profiles and video interviews are what make us the premier placement service in the country. Beacon Hill Nannies clients are given direct and unfettered access to these valuable resources in order to ensure that process is optimized.
I understand that these resources are proprietary to Beacon Hill Nannies, Inc. and agree I will not solicit or engage in any commercial capacity (including a temporary or full time employee or contract agreements) with BHN nannies/governesses outside of this BHN agreement. Any controversy or cliam arising out of, or relating to, this contract, or the breach thereof, shall be settled by arbitration in accordance with the Rules of the American Arbitration Association in Middlesex County, Mass. The judgement upon the award rendered by the arbitrator(s) will be entered in the courts of Middlesex County, Mass.
By “submitting” this application and agreement, I agree I shall not hire, or refer to others, any candidate presented by Beacon Hill Nannies, Inc. without full consent of the Company. I agree for a period of 18 months from the date of this contract I shall not directly or indirectly hire or employ BHN’s nanny/governesses without the express consent of our company. I further agree any attempt to employ, or refer employment of any Beacon Hill Nannies, Inc. candidate without such consent will result in full payment to Beacon Hill Nannies, Inc. of $12,000.00. |
